Tax Policy, Tax Compliance, Tax Administration, and the Collaborative Economy at a Crossroads

In recent years, we have witnessed the emergence and proliferation of new digitalized business models, sometimes referred to as the ‘collaborative economy’. Epitomized by enterprises such as Uber, Airbnb and Taskrabbit, the collaborative economy allows private individuals to provide services to others through online platforms in exchange for consideration, by monetizing the idle capacity of private assets and resources. The collaborative economy is bringing about the advent of meaningful changes to the composition of labor markets. These business models create valuable opportunities for individuals to diversify their income streams. However, they also invite questions about how the income-generating activities of individual service providers should be brought within the net of taxation. Service providers are not always visible to tax administrations, and the income tax rules that govern the treatment of peer-to-peer activities are anchored in principles that facilitate non-compliance. This lecture will provide a brief background into the tax policy, compliance and administration challenges revolving around individual service providers in the collaborative economy. It will also provide an overview of the measures that have been put in place by OECD and EU Member States with a view to addressing the income taxation of individual service providers and highlight why complete and cohesive solutions to the underlying issue are difficult to attain.

Speaker Biography

Alice Draghici is a doctoral researcher at the Maastricht University Faculty of Law and a member of the Ius Commune Research School. Her research is focused on issues of tax compliance and administration in the digitalized economy. She teaches Bachelor and Master courses in comparative income taxation, international and EU tax law.
